Acceptable Use Policy
This policy forms part of the Terms of Service. It matters most for the dialer and messaging features, where the law places obligations directly on you as the caller or sender.
1. Scope
This Acceptable Use Policy applies to every user of Openbiznis and to anyone the Customer permits to use it. Breaching it is a material breach of the Terms of Service.
2. General prohibitions
You must not use Openbiznis to:
- break any applicable law or regulation, or infringe anyone's rights;
- store or transmit malicious code, or attempt to gain unauthorised access to any system, account, or data;
- probe, scan, or test the vulnerability of the platform without our prior written consent;
- circumvent or attempt to circumvent authentication, permission scoping, rate limits, or usage quotas;
- reverse-engineer, decompile, or attempt to derive source code, except where mandatory law permits it;
- resell, sublicense, or provide the platform to third parties as a service without our written agreement;
- upload content that is unlawful, defamatory, harassing, or infringes intellectual property; or
- impose an unreasonable load that degrades the service for other customers.
3. Telephony and the dialer
Voice calling is regulated, and the obligations sit with you as the caller. When using the dialer you must:
- have a lawful basis to call each number, and comply with the ePrivacy Directive and its national implementations on direct marketing;
- respect national do-not-call registries and honour opt-out requests promptly;
- observe permitted calling hours in the recipient's jurisdiction;
- present accurate caller identification, and never spoof a number you are not authorised to use;
- identify yourself and the organisation you are calling for at the start of the call; and
- use only numbers you are lawfully entitled to use.
Where you enable call recording, you are responsible for obtaining any consent or giving any notice the recipient's jurisdiction requires — in many European jurisdictions all parties must be informed before recording begins.
You must not use the dialer for automated dialling into random or sequential number ranges, silent or abandoned calls, or any campaign designed to conceal who is calling.
4. Messaging and social automation
When using messaging, DM automation, or the Manychat integration you must:
- obtain consent where the applicable law requires it before sending marketing messages;
- include a clear and functioning opt-out in marketing communications, and honour opt-outs promptly across every channel;
- comply with the platform policies of Meta, WhatsApp, and any other connected channel — including their rules on messaging windows and template approval; and
- not send unsolicited bulk messages, or use automation to evade a platform's rate limits or anti-spam controls.
5. Data you upload
- Only upload data you have the right to process, with a valid legal basis.
- Do not upload special category data under Article 9 GDPR, or criminal conviction data under Article 10, unless we have agreed to it in writing in advance.
- Do not upload payment card data. Openbiznis is not a cardholder data environment and is not PCI DSS certified.
- Keep lead and contact data accurate, and delete it when you no longer have a basis to hold it.
6. Account and credential hygiene
- One account per person. Shared logins defeat the audit trail and are prohibited.
- Enable multi-factor authentication where your role requires it, and do not attempt to bypass step-up verification.
- Remove access promptly when someone leaves your organisation or changes role.
- Report suspected compromise to ceo@launchzy.eu without undue delay.
7. Reporting vulnerabilities
If you believe you have found a security vulnerability, email ceo@launchzy.eu with enough detail to reproduce it. Please give us a reasonable opportunity to remediate before any public disclosure. We will not pursue action against researchers who report in good faith, avoid privacy violations and service degradation, and do not access or modify data beyond what is needed to demonstrate the issue.
8. Enforcement
We investigate suspected breaches. Depending on severity we may ask you to remediate, throttle or suspend a feature, suspend the account, or terminate the agreement under the Terms of Service. Where continued use presents an immediate risk to third parties, to the platform, or to us, we may suspend first and discuss immediately after.
Where the law requires it, we will report unlawful activity to the relevant authority.
9. Changes
We may update this policy as the product and the regulatory landscape change. Material changes are announced to account holders with at least 30 days' notice.
